. a footnote, this might be a pyrrhic victory for the defense if they win because even if they win with the summers issue, the government can still argue that it was a legitimate, they had a reasonable suspicion, and, therefore the evidence obtained could still be admissible. i was asked to talk about another case which is a case -- >> why don't you take a minute and a half? >> maryland vs. king, and the question is here to the liberty of the state and federal laws that allow for the collection of swabs of cells from the insides of mouths of people who have been arrested. there as 27 states who have laws allow officers to swab the inside of any mouth of anybody arrested, and that gets put into the system who helps to identify the person, but also connect them to other crimes. in this case in maryland, king was arrested for burglary, swabbed, it comes back with a hit for a case involving rape. the court of appeals ultimately found it should have been suppressed, thereby invalidating the law in maryland which is the law in 26 other states allowing that swabbed people are arrested. th

will focus on local issues hitting the president on defense cuts. it's clear the 47% issue is a drag on romney's campaign. he went out of his way at every stop yesterday to show a more compassionate side. >> i've been across this country. i think the president cares about the people of america. i care about the people in america but i know how to help the people of america. with he have people that are hurting. we have people that are disabled and people who are poor. they need our help and receive our help. we're a charitable people. >> when asked how he can understand the problems of the middle class given his personal wealth, he tauted his massachusetts health care overhaul. >> don't forget i got everybody in my state insured. 100% of the kids in our state have health insurance. i don't think anything shows more empathy and care about the people of our state than that kind of record. >> the question was not about health care. romney went from the interview to a toledo rally where he then slammed the president's health care law. >> obama care is exhibit number one of the president'

of the defense sequester that somehow is protected it's not pro tented as you were pointed out last night. >> there is -- i sort of felt like because the romney campaign has been so absent on issues of natural security, substantive issues of national security beyond just name calling i feel like the campaign should be encouraged now that they have tried to talk about veterans issues. there are huge issues with the disability claims but also other elements of the v.a.'s performance in terms of this current generation of veterans and older generations of vets and romney in trying to go there, in virginia this week, showed he didn't even understand the issue he was trying to make political hay out of. the problem of suicides among veterans and says a solution is he won't cut military spending in the sequester. you know, i don't think he knows what the relationship of the v.a. funding is to the sequester. i'm not sure he knows that paul ryan voted for that sequester or that at this point wars are the way you make new veterans if he's threatening new wars in iran and syria the way he's been so

issues, attacking the president on sequestration, the looming defense budget cuts effectively linking defense and national security to the economy which has been his primary message. the campaign has been flooding reporters with numbers and he mentioned them today, suggesting that sequestration cuts would effectively have an impact on 168,000 jobs, costing 168,000 jobs in the state. he said 136,000, 68,000 among small businesses specifically. and he was here with people in this critical battleground who he said have been to battle before. these are people in the military community, a lot of veterans here at american legion hall where he was speaking that he hopes will support his message of american strength through strength and not through weakness militarily. >> i have been a little puzzled by the campaign's posture on this because it was a republican and democratic agreement, the automatic triggers for these automatic cuts from sequestration if they didn't agree to a budget deal, and they didn't agree to a budget deal so this was something that the president and john boehner agreed

. >> thanks for being here. i am part of the children's defense clinic here at richmond. we recently read miller v. alabama. what do you feel about the treatment of juveniles in the justice system? to their need to be any changes? >> the way i view my job is actually to decide cases, and not the state lots of views about, here is what i think about penal reform, or here is what i think about children in the justice system. there are a range of legal questions that i might have views about, but in the end, it is really -- that is not the way i conceive my role. i conceive my role as a judge to decide particular cases, and the issues in those cases that come before me. in miller and jackson, speaking for five members of the court, i addressed one of those questions, which was a question about mandatory life without parole sentencing for juveniles. as my vote reflects, i thought mandatory life sentencing for juveniles is inappropriate, and the justice should have discretion to decide whether it is life without parole or some lesser penalty. in signing that case, i am not deciding, and will n

middle class families, that was almost an entirely defensive ad. and that quinnipiac/"new york times" poll showed why. there was a question in there that asked, does obama, does romney care about the middle class, the rich, the poor, or everyone equally? most polls the that give four choices usually get scattered answers. 58% of the people in ohio said that mitt romney's policies favored the rich. by contrast, 59% said that obama's policies favored either everybody equally or the middle class. that's a 17-point gap. and i think the auto rescue is part of it. those bain ads are part of it. ken blackwell, the former republican secretary of state was on cnn today. and he said it was just like '04. bush roughed up kerry in the summer and kerry never recovered. and he didn't say romney will never recover, but the implication was, romney's in a heap of trouble. >> chris redfern, who is the chairman of the democratic party in ohio also with us tonight. chris. a very untenable position that governor kasich is being placed in, to go out and talk about the economy when it's all positive for wo

things, not just going after entitlements cut domestic spending, defense, but also to raise taxes? you need to do all those things, do you feel? >> we need to do whatever it takes to solve this problem, and that probably takes all of these things. overall, you have to deal with this whole problem, and is once you have cancer, just living in denial, which is the best way to describe how we are living now, it gets worse, and that is happening every day. if you look at these charts that we have distributed over the country, and people going from city to city, talking directly, and i can hear in my home town they will be talking in the next few days, directly to the people, and we need to get the american people alive and alert, because the typical person running for office is gone to do what ever it takes to get their vote. i do not think he has any sense at all that they want this fixed. if we have that at the grass- roots level, he would have these people with different personalities, being reborn, and they would be out on the campaign trail. >> both parties are responsible for our curr

that, all right, and then he can put the president on the defensive a few times, he'll gain. >> last thing on this. what do you think of the expectations games going on where each candidate is trying to outdo each other complimenting the other's debasing prowess? >> it's like a football game. you know those people, you know. it's play it down, tamp it down. it's all a game. >> let's talk about the book, "killing knennedy." how do you feel about president kennedy and did that change? >> you know, kennedy died i was 13 and i opened the book where i was, i was at high school out on long island and came over the loud speaker and everybody alive then knows where they were. but people don't know whoion kennedy was. and that's number one. after reading "killing kennedy" you'll know both good and bad. we don't hold back. you'll know everything. two, they don't know how he was killed. and we got access to the fbi agent who was assigned to marina oswald. we know everything he did. this is all new information. i think people are going to be stunned when they read it. it snaps your head back. >>

to military and defense spending or the bush tax cuts. >> are you talking about the bush tax cuts on all income levels? >> there is no qualification in that statement. what i said, and i still stand by, there are three things that doubled on national debt -- the bush tax cuts, -- >> the question is, do you want to expire them in total? there was no qualification. >> i am getting there. i think, and i still say, that we have to look at every single one of them and determine if we can use some of that money to pay down our national debt. we can lie to the american people or tell the truth. the truth is that those tax cuts, if we let them expire, will increase our national debt by almost one-half. >> what is your position, mr. cruz? >> i would not allow the bush tax cuts to expire. i'm curious. i will commend mr. sadler. he is running a campaign with a great deal of courage because he is running and i'm -- unapologetically liberal campaign and is running in support of raising taxes, a host of liberal views. i commend him for his candor in that. i do not think those are the values of most te

. but that should give us a little space for people to feel less defensive so that we can in fact root out those acts and behaviors. i wanted to ask a little bit about your work at the museum because obviously as you point out, these are imaginary representations of indian. talk to me about how the actual historic work that you're doing at the museum in d.c. helps to counter these images. >> well, we have museums in both washington and new york, and in both of these museums, we're trying to represent native cultures in an appropriate way. when i say in an appropriate way, what we really mean is that we involve the indigenous nations themselves in the representations of their cultures and histories. for many, many years, educational institutions, including museums, took it upon themselves to say we're the experts and we know who -- what these people are. we do a very different thing and most museums do now. say you can't have an authentic representation of native people unless you involve them in the creation of these exhibitions and programs. so in both of our museums, we're just trying to get p
